1. Agreement

By downloading or using the Whoala app, you agree to these terms. If you don't agree, don't use the app. These terms are an agreement between you and Whoala ("we"), not with Apple or Google.

2. What Whoala is (and isn't)

Whoala is a self-control tool: it adds friction between you and the apps you choose to block. It is not a security product, a parental-control guarantee, or a medical or therapeutic device. A determined person, including you, can bypass it, for example by uninstalling the app. We make no promise that any app will remain inaccessible in all circumstances.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use Whoala on devices you own or control, for personal, non-commercial use, in line with the usage rules of the App Store or Google Play. You may not copy, modify, distribute, sell, reverse-engineer, or attempt to extract the source code of the app, except where the law permits it despite these terms.

4. Free version and Whoala Pro

The core app is free: every key type, up to three keys in any combination. Whoala Pro (as many keys as you like) is a one-time in-app purchase (€14.99 or local equivalent). Payments are processed by Apple or Google; refunds follow the refund policy of the store you bought it from. Pro is not a subscription and never renews.

5. Acceptable use

Use Whoala only on devices you own or are authorized to configure, and only in ways that comply with applicable law. Don't use it to interfere with someone else's device without their knowledge and consent.

6. Privacy

Whoala collects no personal data. The details are in our Privacy Policy, which is part of these terms.

7. Disclaimer of warranties

Whoala is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that blocking will work in every situation: operating system updates, device settings, or other apps can affect it. Nothing in these terms limits warranties that consumer law grants you and that cannot be waived.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits or data, arising from your use of (or inability to use) Whoala. Our total liability for any claim is limited to the amount you paid for the app in the twelve months before the claim, or €15 if you paid nothing. Nothing here excludes liability that cannot be excluded by law.

9. Intellectual property

The app, the Whoala name, the koala, and all related content are ours or our licensors'. These terms give you no rights to them beyond the license above. App names shown on this site (Instagram, TikTok, and others) are trademarks of their respective owners; Whoala is not affiliated with or endorsed by them.

10. If you got Whoala from the App Store

These extra terms apply when you use the iOS app: Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to a warranty, you may notify Apple and Apple will refund the purchase price; Apple has no other warranty obligation. We, not Apple, are responsible for addressing any claims relating to the app, including product liability, legal compliance, and intellectual-property claims. You confirm you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Changes and termination

We may update these terms; material changes will be announced in the app or on this page before they take effect, and continued use means acceptance. You can end this agreement anytime by deleting the app. We may terminate your license if you materially breach these terms.

12. Governing law & contact

These terms are governed by the laws of [country of incorporation], without affecting mandatory consumer protections where you live. Questions? Write to hello@whoala.app.
